Unlawful Internet Gambling Enforcement Act

The Department of the Treasury and the Federal Reserve Board (Agencies) issued a joint final rule on December 18, 2008 to implement the Unlawful Internet Gambling Enforcement Act. The Act "prohibits any person engaged in the business of betting or wagering (as defined in the Act) from knowingly accepting payments in connection with the participation of another person in unlawful Internet gambling." The final rule requires a strengthened screening process at the time of account opening to deny commercial entities that may be acting as Internet casinos access to the payments system. It also requires that policies and procedures be implemented to prevent all debit and credit card payments to Internet casinos. It does not require that checks, ACH payments, or wire transactions related to Internet gambling be monitored or blocked. A six month reprieve on mandatory compliance with the Internet Gambling prohibition ends on June 1, 2010 when all banks must institute policies and procedures to block certain prohibited transactions.

Oh my... that means that they are going to tighten things up tighter and less people are going to be able to play. What is ACH payment? I don't think I've heard of that before.

The Unlawful Internet Gambling Enforcement Act comes into full effect Tuesday nearly four years after Congress passed the law under controversial circumstances. The law aims to stop online gambling by preventing credit card companies and banks from processing fund transfers for unlawful Internet gambling. But the law is ambiguous because it only loosely defines what constitutes unlawful gambling.

The concern for big online poker firms: Will banks and financial firms decide any online gaming is more trouble than it’s worth and stop facilitating transactions that have anything to do with it? This was partly the reason that last November the Treasury Department and the Federal Reserve decided to delay till today required compliance with the law by blocking regulations to implement the legislation.

“It is likely to make life more difficult for banks — especially small community banks — who will find it a great burden to police transactions that might be related to Internet gambling,” says Kevin Di Gregory, a partner at Manatt, Phelps & Phillips who used to oversee Internet gambling enforcement at the Justice Department. “There are already banks that are refusing to engage in transactions that might be questionable.”

Ok I really need help and please forgive me on this.
I live in Indiana and that is one of the states that makes gambling illegal. But I play at a site where you can exchange your points for bonus bucks at one of their pay sites. If I win with these bonus bucks and don't make a deposit would it be illegal for the site to send me my winnings through bank wire?
Sorry to sound so dumb on this matter. I want to do things the legal way but confused on what my rights on even on free bingo.

HI Midnight!! If you go to a pay to play site and it is illegal to gamble online in Indiana, you are breaking the law and if they catch you, I am assuming they will prosecute. Always keep in mind, there will come a day when a state will have to have someone to use as an example of what breaking this law will bring on. My theory is "don't do the crime if you can't do the time".

Don't hold your breath until they make it legal again. Not only to you have your State against you but you also have the nation against you now. My suggestion is to just leave it there and forget about it.

How true that is. Having and State and Nation against you and needing someone to hold up to the public as a scapegoat seems to have the three on a match syndrome. Someone is going to die and you just have to make sure it is not you.

Probably the best thing you can do for yourself until this cools down a little. I would imagine they will try one case and depending on the outcome things could change.

I was reading online some where something abut reviewing the gambling law in July, is this true or is the site I read this at wrong? I can't remember which site is was that I seen this at.
